These Terms of Service (“Terms”) govern your use of mediakitlab.com and all tools on the Platform, including ColabRate, operated by MediaKit Lab (“we”, “us”, “our”).

By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. About the Platform

MediaKit Lab is a suite of professional tools built for Indian content creators. ColabRate is our brand deal rate calculator that helps creators determine appropriate INR rates for brand collaborations based on India market benchmarks.

The Platform is intended for:

• Content creators calculating brand deal rates
• Creators generating and sharing rate card documents
• Creators managing brand collaboration pricing

2. Eligibility

You may use the Platform if you:

• Are at least 13 years of age
• Are a human user (no bots or automated accounts)
• Provide accurate information when creating your account
• Have not been previously banned from the Platform

By using the Platform, you represent that you meet these requirements.

3. Your Account

Registration

You may register using your email and password, or by signing in with Google. You are responsible for maintaining the security of your account credentials.

Accuracy

You agree to provide accurate, current, and complete information when registering and to keep your account information updated.

Security

You are responsible for all activity that occurs under your account. Notify us immediately at support@mediakitlab.com if you suspect unauthorized access.

One account per person

Each person may maintain only one account. Creating multiple accounts to circumvent limitations is prohibited.

4. Acceptable Use

You agree to use the Platform only for lawful purposes. You must not:

• Use the Platform to send spam or unsolicited emails
• Attempt to reverse engineer, scrape, or copy the Platform
• Use automated tools to access the Platform at excessive rates
• Impersonate another person or entity
• Use the Platform to engage in deceptive practices toward brands
• Attempt to gain unauthorized access to other users' accounts or data
• Use the Platform in any way that violates applicable Indian law or international law

5. Rate Card Data and Accuracy

Benchmark data

The rate benchmarks used by ColabRate are based on our research into the Indian creator market. These are estimates intended as guidance only.

No guarantee of accuracy

We do not guarantee that the rates generated by ColabRate reflect actual market rates, brand expectations, or successful negotiation outcomes. Rates vary significantly based on factors beyond what our calculator captures.

Your responsibility

You are solely responsible for the rates you charge brands. MediaKit Lab is not responsible for any brand deal outcomes, negotiations, or disputes arising from your use of ColabRate's output.

Not financial or legal advice

Nothing on the Platform constitutes financial, legal, or professional advice. Consult appropriate professionals for advice specific to your situation.

6. Email Feature

When you use the “Email to brand” feature:

• You confirm you have a legitimate reason to contact the brand email address you provide
• You must not use this feature to send spam or unsolicited bulk emails
• You are responsible for the content of any personal messages you add
• We are not responsible for brand responses or outcomes of emails sent through the Platform
• Misuse of this feature may result in account termination

7. Intellectual Property

Our content

The Platform, including its design, code, benchmark data, and content, is owned by MediaKit Lab and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Platform without our written permission.

Your content

You retain ownership of rate cards and data you create using the Platform. By saving data on the Platform, you grant us a limited license to store and process it to provide the service.

Feedback

If you provide feedback or suggestions, you grant us the right to use that feedback without compensation or attribution.

8. Free Tier and Paid Plans

Free tier

The free tier is provided as-is with limitations that may change at any time. We reserve the right to modify, limit, or discontinue free tier features with reasonable notice.

Paid plans

Paid plan terms, pricing, and features will be specified at the time of purchase. All prices are in INR unless otherwise stated.

No refunds

Given the digital nature of the Platform, we generally do not offer refunds. Exceptions may be made at our discretion for genuine billing errors.

9. Disclaimers

The platform is provided “as is” without warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Platform will be uninterrupted or error-free
• Rate calculations will be accurate or result in successful brand deals
• The Platform will be available at any particular time

10. Limitation of Liability

To the maximum extent permitted by applicable law, MediaKit Lab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of the Platform.

Our total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed ₹5,000 or the amount you paid us in the past 12 months, whichever is greater.

11. Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Abusive behavior toward the Platform or other users
• Extended inactivity (more than 12 months)
• At our sole discretion with reasonable notice

You may delete your account at any time by contacting support@mediakitlab.com. Upon deletion, your data will be removed within 30 days.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in India.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via email or a notice on the Platform. Your continued use after changes constitutes acceptance of the updated Terms.
